上海市知識産権局と市著作権局、市商務委員会がこのほど「上海市の電子商取引分野における知的財産保護活動に関する若干意見」を公布した。9月15日より施行される。
この「若干意見」は、2021年6月に試行版として公布されていたものを、試行の効果や電子商取引分野での新たな課題、国の新しい政策要求などを踏まえ、改正・整備したうえで規範性文書として正式にまとめたものである。
今回の「若干意見」には、知的財産部門が電子商取引プラットフォームの運営者や出店者に対し、知的財産管理を規範化し、知財保護能力の向上を促すことを求める管理規定が新たに盛り込まれた。また、プラットフォーム事業者の責任を強化する観点から、「合理的な審査と注意義務を果たすこと」「侵害を知り、または知り得た場合には速やかに必要な措置を講じること」などの内容が追加された。
