Em recente julgamento sob o rito dos recursos repetitivos, a Primeira Seção do Superior Tribunal de Justiça (STJ) concluiu que, nas ações de improbidade administrativa, é possível revisitar e eventualmente modificar decisões anteriores que tenham determinado a indisponibilidade dos bens dos réus, em razão da aplicação imediata da Lei nº 14.230/2021 (Nova Lei de Improbidade), que alterou os requisitos para bloqueio de bens.

A decisão uniformiza o entendimento jurídico sobre a aplicação da Nova Lei de Improbidade, conferindo maior proteção ao patrimônio dos investigados ao reintroduzir o requisito da urgência para admitir a decretação da indisponibilidade de bens.

No regime legal anterior, exigia-se somente a demonstração de fundado indício da prática de ato de improbidade administrativa para o deferimento do pedido de indisponibilidade de bens, presumindo-se que haveria risco em aguardar a natural tramitação do processo. Contudo, a Nova Lei de Improbidade
