Does your business supply goods or services to individual consumers using non-negotiable contracts? Does your website have a terms of use? Do you currently use standard form engagement letters, or shrink wrap end user agreements? If you have answered 'yes' to any of the above questions, you may have to review and amend your current suite of standard-form contracts to ensure that they comply with the recently proposed unfair consumer contract laws.

On 24 June 2009 the Trade Practices Amendment (Australian Consumer Law) Bill 2009 (Bill) was introduced into Federal Parliament. The Bill deals with unfair and prohibited terms in consumer contracts and seeks to amend the Trade Practices Act 1974 (Cth) (TPA) and Australian Securities and Investment Commission Act 2001 (Cth) (ASIC Act).
