Suyash Srivastava is a Partner at DSK Legal. He advises companies on all labour and employment law related matters, particularly advising clients in the area of Employment & Service Laws, HR Compliances, Due Diligence and Litigation. He also advises companies in conjunction with individual legal issues, mass redundancies and proceedings relating to unfair dismissals.

Suyash and his team represent companies in labour court proceedings against employees and trade unions. Suyash along with his team of dedicated, experienced and trained lawyers have also acted as independent external investigators for various multinational companies for investigations pertaining to various internal policy violations i.e. workplace harassment, whistle-blower policy, code of conduct, fraud, sexual harassment etc.

Experiences 

  • Advised Associated Press on issues in relation to termination of employees, redundancy issues, employee performance issues, documentation of employee contracts and labour law compliances, amongst others.
  • Advised Bank of Nova Scotia with respect to employee related matters, closure of its offices and issues pertaining to restructuring of existing hierarchical grades in the Company.
  • Advised Cairn Energy India Private Limited on employee benefit legislations applicable to foreigners in India, labour legislations applicable to building construction workers in relation to Cairn oil fields and pipelines, regimes governing transportation of petroleum and other industrial legislation requirements in the oil and gas sector.
  • Advised Intel Technology on various employee / service law compliance issues and advising them on day to day basis on operational matters ranging from compliances under various labour laws to drafting of various employment agreements and policies. Currently handling several employee related litigations on behalf of Intel.
  • Advised Lockheed Martin on the compliances required for setting up offices in India, including drafting and negotiation of employment contracts.
  • Advised United HealthGroup on various employee/ service law compliance issues, and assisting them on day to day operational issues (such as resignation, termination, abandonment, retrenchment, etc.) Conducted an HR audit for the UnitedHealth Group and also drafted various agreements and policies. Also opined on issues pertaining to enforceability of service bonds, ESOP, non-solicitation and non-compete agreements, non-disclosure agreements, etc. Also drafted various policies such as (superannuation fund scheme, provident fund scheme, the employee rules and regulations, code of conduct, policy to prevent sexual harassment, employment agreements, trainee agreements, confidentiality agreements).
  • Currently advising Lufthansa on various employee/ service law compliance issues, and assisting them on day to day operational issues (such as resignation, termination, abandonment, retrenchment, etc.) Involved in serving of legal notices to employees indulging in activities pertaining to breach of confidentiality obligations and also drafted various contracts and agreements for Lufthansa. Handled certain employee related litigations and also have conducted a detailed HR Audit.
  • Currently advising the Fidelity group on various employee/ service law compliance issues, and assisting them on day to day operational issues (such as resignation, termination, abandonment, retrenchment, etc.) and in obtaining registration under the Shops and Establishment Act, Contract Labour Act, Inter-State Migrant Workmen Act, Employee State Insurance Act, etc. Also drafted various policies such as (superannuation fund scheme, provident fund scheme, the employee rules and regulations, code of conduct, policy to prevent sexual harassment, employment agreements, trainee agreements, and confidentiality agreements).
  • Currently advising the TLG India (formerly Sapient) on various employee/ service law compliance issues, and assisting them on day to day operational issues (such as resignation, termination, abandonment, retrenchment, etc.) Advised Sapient with respect to various assignment scenarios into and outside of India with respect to compliance with Employees Provident Funds and Miscellaneous Provisions Act, 1952. Involved in the drafting and vetting of Sapient’s data privacy policy and advised them on issues pertaining to conditions of service such as overtime and leave related issues. Also advised them on various internal employee investigations re company policy violations. Also drafted various policies such as (superannuation fund scheme, provident fund scheme, the employee rules and regulations, code of conduct, policy to prevent sexual harassment, employment agreements, trainee agreements, confidentiality agreements).
  • Currently advising Trinity College, London, on a criminal matter pertaining to fraud and forged certificates.
  • Drafted various agreements, schemes and policies such as the superannuation fund scheme, provident fund scheme, the employee handbook, employment agreements, code of conduct, and policy to prevent sexual harassment and the employment agreements for COLT Technology Services India Pvt. Ltd and assisted them in obtaining registration under the state specific legislations. Also drafted various policies such as (superannuation fund scheme, provident fund scheme, the employee rules and regulations, code of conduct, policy to prevent sexual harassment, employment agreements, trainee agreements, confidentiality agreements)
  • Represented and Advised JCB India, before the Supreme Court of India, with respect to a matter involving regularization of trainees.
  • Represented and advised Sealed Air Inc. in a high profile employee litigation matter involving breach of confidentiality obligations.
