Unsolicited Commercial Communications through telecom resources

IRDAI has instructed all Regulated Entities ("REs"), insurers and insurance intermediaries not to call customers from an unauthorised 10-digit mobile number and landline numbers to curb Unsolicited Commercial Communications through voice calls or messages, in line with the guidelines of Telecom Regulatory Authority of India ("TRAI") dated May 4, 2024.1 An IRDAI licensed RE, sending a commercial communication to their existing or prospective customers must fulfil TRAI prescribed regulatory requirements and get registered with any of the telecom service providers.

The Supreme Court Of India Clarifies: Order II Rule 2 Of The Code Of Civil Procedure, 1908 Cannot Be A Ground For Rejection Of Plaint Under Order VII Rule 11(D) Of The Code Of Civil Procedure, 1908

A two judge bench of the Hon’ble Supreme Court of India (“Supreme Court”) in S. Valliammai and Ors. vs. S. Ramanathan and Anr. recently held that Order II Rule 2, Code of Civil Procedure, 1908 (“CPC”) cannot constitute a ground for rejection of plaint under Order VII Rule 11(d) of the CPC. The Supreme Court drew a critical distinction between the two provisions clarifying that while Order II Rule 2 curtails the right to sue for certain claims or reliefs, but it does not bar filing of a suit under Order VII Rule 11(d) of the CPC.

The Supreme Court Of India Upholds Inclusion Of Subsidiary Assets In Resolution Plans Through Lifting Of The Corporate Veil

By way of the Impugned Order, the NCLAT had set aside the National Company Law Tribunal’s (“NCLT”) approval of 3 (three) project-wise resolution plans of Earth Infrastructures Limited (“CD”).
