Career

Ms. Li is a partner of the Intellectual Property division in Haiwen & Partners (Shenzhen) and mainly based in Beijing.  She has expertise and abundant practice in patent portfolio, administrative litigation and infringement litigation in the fields of pharmaceutical and chemistry, as well as other dispute resolution related to trade secret protection, patent ownership disputes and etc.

Ms. Li began her career at CNIPA (National Intellectual Property Administration, PRC) in 2003, as a patent examiner.  From 2007 to 2020, she was reassigned to the Medicine and Biology Appeal Division of the Patent Reexamination Board (PRB), engaged in patent reexamination, invalidation and administrative litigation, as the leader of the Appeal Division.  Ms. Li joined Haiwen as the partner of Intellectual Property in September 2021.  Before joining Haiwen, she worked with King & Wood Mallesons (KWM) Beijing Office as a senior consultant for nearly a year.

Ms. Li has deep understanding of pharmaceutical technologies and Chinese IP law system.  During her 18-year working experience as an examination officer, Ms. Li has represented CNIPA and PRB in multiple typical cases in the pharmaceutical field, some of which have been ranked into the Annual Top 10 cases of the PRB, or posted as the typical cases, the excellent cases, the highlights cases in the CNIPA quality evaluation.  Ms. Li has also participated in and substantively contributed to the establishment and amendment of patent examination rules and regulations.  Ms. Li and her team won multiple high-level honors and awards by their contributions in researching laws and regulations, analyzing individual cases, solving hot and complicated problems and establishing examination standards in the pharmaceutical field.

During her career at the PRB, Ms. Li was entitled as a senior training mentor and an examination expert.  She has participated in various research programs and developed a series of fundamental IP courses for all CNIPA’s examiners, including “Creativity Evaluation”, “Evidence Judgment of Legal Thinking Series Courses”, “Overview of Patent Invalidation Proceeding” and “Patent Reexamination Proceeding”.   Besides, Ms. Li made some public lectures including “Evidence Identification Standard in Invalidation Proceeding”, “Drafting Patent Application and Replying to Office Action”, “Judgment of Novelty and inventiveness for Pharmaceutical Inventions”.  Ms. Li also participated in the compilation of “Analysis of Typical Cases of Invalidation in Pharmaceutical & Biological Field”.

When she worked in KWM, Ms. Li attended 2021 China Intellectual Property Summit as the host of the pharmaceutical sub-Forum of the Summit.  During the summit, she made a keynote speech entitled “The Status and Characteristics of Chemical Drug Patent Cases”, and gave the following lectures to pharmaceutical companies: “Analysis of Amendment of Examination Guidelines and Hot Topics in Pharmaceutical Patent Field”, “ASEAN Trade Secret Protection”, “Overview of Pharmaceutical Enterprise’s IP Protection”.

She also conducted a comparative study on the recent revision of European patent examination guidelines, and published the following articles: “Antibody Patent Examination Practice – From the Perspective of The New EPO Examination Guidelines” and “Unity Is Not Simple – A Preliminary Study of China-Europe Examination Principles”.

Memberships

Ms. Li was awarded as a High-Level talent of the CNIPA and was elected as a member of the Five Chief Agents Ad Litem of the PRB.

Education

Ms. Li received her B.S. and M.S. from Shenyang Pharmaceutical University.  She has a graduate degree in civil and commercial law from China University of Political Science and Law, and obtained a legal professional qualification certificate in 2014.
