Position

Ed is a specialist employment practitioner with substantial commercial litigation experience. Ed has advised and appeared in a number of substantial commercial disputes across a range of work including directors’ liabilities, fiduciary duties and employment issues. Ed is Head of St Philips Employment Group, a member of the Attorney General Panel of Counsel and a fee-paid Employment Judge. With a well-established and recognised profile of working for national companies and plcs, as well as for senior and board level employees, Ed is well aware of the commercial pressures and broader realities of litigation and maintains a strong following in emergency injunction work. Ed deals with the range of employment disputes in tribunal, including high value and complex litigation. His High Court experience extends to claims for senior executives and involving directors’ duties. He is frequently engaged to advise and represent in injunctive relief in employment disputes. A member of the Attorney General Panel of Counsel, Ed’s clients include numerous central government departments and external agencies. His private clients include national companies, plcs as well as numerous SMEs. His recent employment experience includes: junior counsel in a complex breach of fiduciary claim in the insurance industry sector, including dishonest assistance, knowing receipt; financial derivatives, in the context of directors’ negligence and constructive dismissal employment tribunal proceedings; appeals to the EAT: Discrimination (relevance of inadequate explanations) and age discrimination (strike out/costs); freezing injunctions and commercial pre-emptive remedies; and substantial TUPE and insolvency issues. Ed’s commercial experience includes: complex fiduciary duty claim in insurance industry sector, involving constructive trusts, knowing receipt and actions against Trustee in Bankruptcy; £1m+ commercial fraud, acting for defendant against leading national car dealership; an international dispute relating to the quality of a monorail system supplied from UK and constructed in Malaysia, c. £2m; and£9m Indemnity swap dispute between two leading national house builders. Ed gives seminars extensively with particular emphasis on commercial/employment issues, such as restraint of trade; TUPE and insolvency; fiduciary duties; performance management. He is an accredited advocacy trainer.
