Park Square Barristers features the full strengths of ‘a range of counsel, from very experienced to very junior’ in a broad social housing and property team, which leads on instructions from both local authorites and social landlords as well as tenants on sensitive matters. Christopher Rafferty and Christopher Machin are experts on the provisions of the Housing Act 1988, Human Rights Act 1998 and the Equality Act, representing tenants facing evictions and possession claims relating to anti-social behaviour, criminal activity and rental arrears, and Kelly Cronin leads on a broad array of cases for social housing providers and tenants alike. The depth of the set is illustrated by a range of barristers with focused practices, with Sophie Phillips leading for tenants on appeals under s.204 of the Housing Act.

Alternative Dispute Resolution

Christopher became an accredited mediator in 2016 and was called to the Bar in 2017. He is a strong proponent of all forms of alternative dispute resolution including early neutral evaluation, arbitration and mediation. Christopher understands the importance of finding solutions to disputes as quickly and as cost effectively as possible, and ADR offers a variety of tools which reduce the need for expensive litigation. ADR can also lead to outcomes that are not available following an adversarial trial, where the court determines the winner who usually ‘takes all’. ADR often leads to both sides making appropriate concessions but also feeling that they have ’won’ to an extent. This can be particularly useful in cases where the parties hope to maintain a good working relationship once the dispute has been resolved.

Christopher acts as both a mediator and for parties within a mediation, and is happy to consider instructions in all civil cases. Christopher has particular expertise in cases relating to breach of contract and commercial property disputes. He is also a strong choice in residential property cases, including boundary disputes, where ADR can be an effective mechanism to resolve or narrow the issues between the parties.
