The Court clarified that the applicant’s “reasonable belief” in ownership can be for any ten-year period during their time of adverse possession. In a separate matter, Kester Lees KC successfully acted for the developer in Cooper v Ludgate House Limited and Powell v Ludgate House Limited, two major rights of light claims arising from a redevelopment project.
