EXECUTIVE SUMMARY

On July 1, 2024, the Texas Data Privacy and Security Act (TDPSA) will become effective. The TDPSA establishes data collection, processing, and disclosure requirements that will apply to many consumer-facing companies doing business with Texas residents. The new law will align Texas with the national trend toward increased data privacy protection while establishing some unique features.

As of mid-April 2024, seventeen states have adopted "comprehensive" data privacy laws, and Congress is again considering privacy legislation at the federal level. These state laws grant consumers significant rights over how their personal data—broadly defined—is collected, used, protected, and disclosed to third parties. Some state privacy laws are currently in effect, while others, like Texas, take effect later this year or in 2025 and 2026.
