On 22 June 2017, the Financial Services and Markets Act 2000 (Markets in Financial Instruments) Regulations 2017 were published, which, amongst other things, implemented parts of the MiFID II Directive.

In particular, these regulations introduced an amendment to the definition of a "qualified investor" Part 6 of FSMA 2000. Section 86 (Exempt offers to the public) of FSMA 2000 was amended so that a "qualified investor" may now also include a person whom the firm continues to treat as a professional client under the guidance published in Annex II of MiFID II.

This amendment will come into force on 3 January 2018.
