The Scottish Court of Sessions has published the reasons for refusing the interim interdict sought by Arriva Scotland West Limited (Arriva) against Glasgow Airport Limited (GAL) in respect of an alleged abuse of dominance. Arriva alleged that GAL had abused its dominant position in breach of the Chapter II prohibition of the Competition Act 1998, by removing its access to the road immediately outside the airport terminal in order to provide a direct bus service to Glasgow city centre. Whilst the Court considered that Arriva had an arguable case, it was not sufficiently compelling as to justify the grant of interim interdict for which there must exist a clear-cut abuse of dominance.
