New CAT chairmen

The President of the Competition Appeal Tribunal has announced that the Lord Chancellor has appointed four new members to the panel of chairmen of the Competition Appeal Tribunal. The new members are Heriot Currie QC (Scotland), Peter Freeman CBE, QC (Hon), Andrew Lenon QC and Hodge Malek QC. Click here

Monitor publishes consultation on draft enforcement guidance

Monitor has published a consultation draft of its proposed enforcement guidance. The draft guidance sets out Monitor's general approach to exercising its enforcement powers in relation to potential and actual licence breaches and other regulatory obligations, including the powers it will have as a concurrent competition regulator in relation to the provision of health care services. Articles 101 and 102

  • The High Court has issued a judgment suspending a private action against Servier by the Secretary of State for Health for breach of Articles 101 and 102 in relation to delaying entry of generic versions of its drug perindopril. The suspension is because of the ongoing European Commission investigation into these issues. Click here.

  • The OFT has appointed two new directors: Gordon Ashworth has been appointed Director of Consumer and Markets Policy in the OFT's Policy Group, led by Senior Director Jackie Holland; and Andrew Groves has been appointed a director in the OFT's Goods and Consumer Group, led by Senior Director Cavendish Elithorn.   • The OFT has launched a formal investigation into a suspected breach of competition law committed by a trade association gathering undertakings active in the provision of training services to the construction industry sector. The investigation is under Chapter I of the Competition Act 1998 and Article 101. Click here.
