I. DAVADAN FERAGAT:

Davacının, açtığı davanın sonucundan vazgeçmesine davadan feragat denir. Feragat kısmen veya tamamen yapılabilir. Feragat ile davacı dava dilekçesinde sonuç kısmında talep ettiklerinden kısmen veya tamamen vazgeçmiş olur. En az açılmış dava kadar önemli ve dikkat isteyen bir işlemdir.

Davadan feragate ilişkin düzenlemeler 6100 Sayılı Hukuk Muhakemeleri Kanununda ''Davaya Son Veren Taraf İşlemleri'' üst başlığı ile madde 307 ve devamında bulunur. Madde düzenlemesinden de anlaşılacağı üzere feragat hakkı davacıya tanınmış bir haktır.

Feragat işlemi ile davacı dava sonucuna ilişkin taleplerinden kısmen veya tamamen vazgeçmiş olur. Yani feragat oldukça önemli sonuçlar doğuran bir usul işlemidir. Bu nedenle feragat hakkını kullanmadan önce veya feragat ederken herhangi bir hukuki hata yapılmaması önemlidir.
