The Data Act, applicable from 12 September 2025, aims notably to facilitate switching between data processing services. In this respect, it sets out the conditions and actions required for a customer to terminate a contract for a data processing service, to enter into new contracts with different providers, to port its exportable data and digital assets, andto benefit from functional equivalence where applicable.

The Data Act's provisions target data processing service providers – particularly cloud and infrastructure services – by mandating customer-friendly switching and data portability mechanisms. These rules are designed to dismantle vendor lock-in, foster competition, and empower users with greater control over their data.
