ANTI-COMPETITIVE ARRANGEMENTS

Section 2(2) of the 1996 Act makes the entry into or implementation of or engagement in an anti-competitive arrangement an offence. Section 4 (2) of the 1991 Act provides a number of examples of anti-competitive arrangements, but these are not exhaustive. The examples given are:

  • directly or indirectly fixing purchase or selling prices or any other trading conditions;
  • limiting or controlling production, markets, technical development or investment;
  • sharing markets or sources of supply;
  • applying dissimilar conditions to equivalent transactions placing others at a competitive disadvantage;
  • making contracts subject to the acceptance of supplementary obligations which have no connection with the subject of the contracts.
