The Ministry of Environment, Forest and Climate Change has notified the Forest (Conservation) Rules, 2022 ("Rules") in supersession of Forest (Conservation) Rules, 2003.1 The Rules essentially lay down the procedural framework to obtain prior approval from the Union Government for the use of forest land for non-forest purposes as provided in the Forest (Conservation) Act, 1980 ("Act"). Such non-forest purposes may include diversion of forest land for a commercial or infrastructure project, de-reservation of land recognized as forest or assignment of forest land to any private person by way of lease. The Rules constitute different authorities at the Union and State / Union Territory level to advise the Union Government in matters involving use of forest land for non-forest purposes. These authorities will advise the Union and State Governments or Union Territory Administration to accept or reject such proposals.

No GST On Assignment Of Industrial Leasehold Rights: Bombay High Court Grants Relief To Industrial Lessees Holding MIDC Plots

In Aerocom Cushions Private Limited v. Assistant Commissioner (Anti-Evasion), CGST & CX, Nagpur-1, the Nagpur Bench of the Bombay High Court quashed a Show Cause Notice demanding Goods and Services Tax (“GST”) on the assignment of leasehold rights in an industrial plot allotted by the Maharashtra Industrial Development Corporation (“MIDC”). The Court held that such an assignment constitutes a transfer of benefits arising out of immovable property and does not amount to a “supply of service” under the Central Goods and Services Tax Act, 2017 (“CGST Act”).
