Germany has adopted the new Act for Critical Facilities (KRITIS Dachgesetz) (the Act) (available here, German only), which entered into force on March 17 , 2026. It implements the Critical Entities Resilience Directive (EU) 2022/2557 (CER) and imposes requirements for physical resilience of facilities in strategic sectors against risks such as natural disasters, terrorist attacks or physical sabotage. Companies in scope must register with the Federal Office of Civil Protection and Disaster Assistance (BBK) and the Federal Office for Information Security (BSI) by July 17, 2026, or within three months of later qualification. The Act also has material implications for the German FDI screening framework.
