中国国家知識産権局（CNIPA）は、公式ウェブサイトで「国家知識産権局による規章の制定手続に関する規定」（局令第83号）を発表した。この規定は、2024年7月11日から社会各界に向けて意見募集を実施した後、同年12月13日に第7回局務会議で承認され、正式に公布された。施行日は2025年2月1日と定められている。
新たに公布された規定は、全7章36条で構成されており、規章制定における基本的な原則や、立法の根拠、適用範囲、名称および体例について明確に定めている。7つの章の内訳は、総則、立案、起草、審査、審議、公布および登録、解釈、改正および廃止、附則である。
今回の規定の公布により、国家知識産権局が規章を制定する際の手続が一層透明かつ体系的になることが期待されている。
