On 15 August 2018 the NSW Government's Fair Trading Amendment (Short-Term Rental Accommodation) Bill 2018 was passed by the Upper House and is now awaiting assent.

The objects of the Bill are to:

  1. Amend the Fair Trading Act 1987 (NSW) to authorise the regulations to introduce a code of conduct applying to participants in the short-term rental accommodation industry; and
  2. Amend the Strata Schemes Management Act 2015 (NSW) to allow by-laws for strata schemes to prohibit short-term rental accommodation in the case of premises that are not the principal place of residence of the person who is giving the right of occupation.

The NSW Government has also announced proposals for a new state wide planning instrument which will place limits on the ability of hosts to rent out properties in Sydney however at the time of writing no planning instruments have been released.
