The Contaminated Land Management Amendment Act 2008 (NSW) was assented to on 10 December 2008, bringing in changes to the Contaminated Land Management Act 1997 (NSW). The new provisions cast a wider net in terms of those with responsibility for reporting, investigating and cleaning up contamination in New South Wales.

The Contaminated Land Management Amendment Act 2008 (NSW) (the Amendment Act) provides the Environment Protection Authority (EPA) with broader powers to issue investigation and management orders. As a result, businesses who own, lease or manage contaminated land in New South Wales may find themselves liable for contamination where they previously had no responsibility.
