Jorge Suescún acted as arbitrator in an international commercial arbitration under the rules of the Bogotá Chamber of Commerce and arising from disputes between the minority and majority shareholders of Blau Farmacêutica. Arbitration: Members of the firm have participated in over 150 arbitrations as counsel, chairman and arbitrator. Those arbitrations involved a wide variety of disputes and were ad hoc or conducted under the rules of major arbitral institutions. Those arbitration proceedings involved a wide variety of disputes in areas as diverse as: banking, broadcasting, concession contracts, construction, corporate, distributorship and agency, energy, engineering, electricity and gas supply, finance, government contracts, infrastructure, insurance and reinsurance, joint ventures, licensing, maritime, mergers and acquisitions, post-M&A, mining and natural resources, real estate, oil & gas, sales, telecommunications, TMT, trusts, turnkey projects and general commercial disputes. Suescun Abogados is perfectly positioned to handle international arbitration procedures in a wide range of sectors, including construction, electricity, oil and gas, among others. Indeed, it regularly handles international disputes as lead counsel under ICC Rules. Recent representative matters: Suescun Abogados successfully represented Carbones del Cerrejon Limited, a multinational which is the largest mining company in Colombia, in a ICC international arbitration, under Colombian law, against a multinational consortium, related to the construction of marine works and structures. The tribunal dismissed all claims (US$60m) brought by the consortium and awarded all counterclaims and damages sought by Cerrejon (US$40m). Consequently, the Tribunal ordered the consortium paying 100% of the costs of the arbitration and all of the costs of Cerrejon’s legal representation.
