Established in 1977 by founding shareholder Michael S Burg, Burg Simpson Eldredge Hersh & Jardine, P.C. is one of the country’s leading plaintiff trial firms. Former senator for Wyoming Alan K Simpson (the Simpson in Burg Simpson) is prominent in the national media. In 2010, Senator Simpson was appointed by President Obama to serve as the co-chairman of the National Commission on Fiscal Responsibility.
Main areas of practice
Mass tort litigation: Burg Simpson is one of the largest law firms handling complex pharmaceutical mass tort and class action litigation in the US. Michael S Burg, former president of the National Trial Lawyers, leads the team. Federal judges have selected Michael and his team to lead numerous high-profile litigations. He is currently co-lead counsel in the Yaz/Yasmin birth control litigation, where he represents thousands of women injured by the oral birth control pill. To date, Bayer has paid almost $2bn in settlements to injured women. Michael has assumed leadership positions in other multi-district litigations involving Ortho Evra, Zyprexa and Vioxx.
Shareholder Peter W Burg was appointed co-lead counsel in the Gadolinium-based contrast agents MDL. Shareholder Seth A Katz was appointed co-lead counsel in the Pradaxa MDL and is also a member of the Plaintiffs’ Executive Committee in the Testosterone Replacement Therapy (TRT) MDL. Additionally, in 2015, Mr Katz was appointed to the Plaintiffs’ Negotiating Committee in the Yaz/Yasmin MDL and helped negotiate a global settlement of $56.9m for Yaz-related ATE cases with Bayer. Janet G Abaray is also a prominent member of the mass tort team, handling Depakote claims.
Personal injury: few firms can match Burg Simpson’s ability to try catastrophic personal injury and wrongful death cases. Michael S Burg leads the personal injury department with Holly B Kammerer and Peter W Burg. Stephen J Burg is also a prominent member of the team. The personal injury team has won numerous verdicts in excess of $1m, including a recently obtained $3.25m jury verdict in a case led by Peter W Burg.
Medical malpractice: Burg Simpson has developed a national reputation for its medical malpractice team, which handles all types of cases, including a wide variety of birth trauma cases such as cerebral palsy, Erb’s palsy and Kernicterus. The team is led by Scott J Eldredge, who frequently lectures across the country including grand rounds at hospitals about medical malpractice law.
Commercial litigation: the firm represents Fortune 500 companies, medium-sized corporations and family-owned businesses, as well as individuals in complex commercial litigation. Burg Simpson’s commercial practice group is headed by Michael S Burg, David P Hersh and David K TeSelle. Burg Simpson took on Wall Street after the 2008 economic collapse and was instrumental in holding them accountable for their wrongful conduct.
Construction defect litigation: Burg Simpson is a recognized leader in the area of construction defect litigation, representing individual homeowners and homeowner associations. Under the leadership of Craig Nuss and Mari Perczak, the construction defect team holds builders accountable to make sure that homeowners do not live in defective homes. In 2015, the construction defect team received the largest jury verdict in the state of Colorado.
