In addition to its US-based team, the firm is able to draw on international offices in London and Hong Kong to handle significant cross-border matters. New York-based litigation department co-chairs Andrew Ceresney and Mary Beth Hogan are instructed by an impressive mixture of institutional clients, with Hogan having developed a niche in sexual abuse and harassment advice; and Mary Jo White maintains a strong reputation for representing companies in government investigations. Washington DC's Arian June was promoted to partner on the basis of her SEC-based practice in 2019.

Dispute resolution > General commercial disputes Tier 1

With first-rate expertise in the healthcare and financial sectors, Debevoise & Plimpton LLP frequently handles some of the most hotly contested litigation in the country. The firm is heavily involved in opioid crisis work: team co-head Maura Monaghan represents certain former directors and shareholders of Purdue Pharma in federal multi-district litigation with projected damages in excess of $1bn. In another highlight, private equity specialist Shannon Rose Selden defended Clayton, Dubilier & Rice in a securities class action lawsuit claiming $4.4bn in damages at the US District Court for the Middle District of Tennesse. Elsewhere, team co-head Mark Goodman represented Tribune Media Company in a number of matters in Delaware and Illinois federal courts in connection with its failed merger with Sinclair Broadcasting Group. Key attorneys with expertise in insurance litigation include chair of the firm's insurance group Maeve O’Connor and Susan Reagan Gittes. Both provide excellent continuity in the insurance space following the retirement of securities and insurance expert Edwin Schallert in December 2018. Also of note is counsel Elliot Greenfield, whose practice includes defending securities class actions.

Dispute resolution > International arbitration Tier 1

A giant in the world of arbitration, New York-based Debevoise & Plimpton LLP offers a full range of service in both international commercial and investment arbitration, where it acts for sovereign states, companies and individuals. The practice group has wide-ranging experience acting on the side of claimants and respondents, and has had recent strong showings in the energy, mining, oil and gas, telecoms, financial services, and pharmaceutical sectors. Clients praise the team’s skills in producing ‘first-rate written product’ and its ability to deliver ‘top-notch advocacy’ during arbitration hearings. This strength showed itself in the group's high-profile $5.8bn win for claimant Tethyan Copper Company in arbitration proceedings against the Islamic Republic of Pakistan; the dispute arose out a mining project in Pakistan, and resulted in the second-largest award ever rendered in the history of the International Centre for Settlement of Investment Disputes (ICSID). Apart from its proven track record of success, the group is also distinguished by the unsurpassed presence of multiple ‘top practitioners in the field’, all prominent in arbitration and public international law affairs. Donald Donovan served as president of the International Council for Commercial Arbitration, and shares leadership of the group with David W. Rivkin – former president of the International Bar Association, who boasts arbitration leadership experience across five continents. Further, Mark Friedman is vice president of the ICC Court of Arbitration; Natalie Reid is a director at the London Court of International Arbitration (LCIA); and Catherine Amirfar, recommended for investor-state arbitration, presides over the American Society of International Law. Ina Popova is routinely involved in disputes arising in Africa and Latin America. Associate Laura Sinisterra has also been singled out by clients.

Testimonials

The best international arbitration practice in the world

An extremely collaborative group of lawyers: their research is precise, their examinations – crisp, and they are incredibly client-oriented.

Debevoise & Plimpton’s lawyers have appeared before me as advocates in ICC cases, where I acted as one of three arbitrators. They are outstanding advocates – among the best I have seen in my capacity as an arbitrator.

Debevoise’s international arbitration team is composed of some of the top practitioners in the field.  They are thoughtful, strategic, and work well together, so that a superior result can be achieved.  The diverse range of experience that the lawyers bring also allows the practice to arrive at novel solutions to complex problems, which is a testament to their capabilities.

Debevoise works in small teams, which makes their work very efficient.

The team’s written work product is first-rate — clear, well written, and focused on the important points. The team members’ oral advocacy is top-notch as well — they focus on the key points, avoid marginal arguments, and are excellent cross-examiners.

I instructed a Debevoise team consisting of Mark Friedman and Ina Popova who are supported by associate Laura Sinisterra (among others) in international arbitration matters. Exceptional team work. Mark is incredibly thorough and a superb orator before the tribunal, especially under pressure during the rebuttal. Ina speaks multiple languages, has a genius academic legal brain, and is a very passionate orator. Laura has a tremendous capacity to assimilate huge amounts of complicated and diverse information and work tirelessly to formulate a legal argument. They really are an exceptional team.

Mark Friedman is extremely knowledgeable, highly skilled, and terrific in client service.

David Rivkin’s oral advocacy was the best I have ever seen.

David Rivkin is the best international arbitration practitioner. David is brilliant in his knowledge, but also the kind of lawyer who can serve as a trusted advisor.

Donald Donovan is a top practitioner, and his level of knowledge and expertise is unparalleled.

Catherine Amirfar is grounded, wildly smart, and tremendously hardworking. Her previous role working for the U.S. State Department provides her with insight that few other practitioners can provide, particularly as it relates to the pressure points that arise in the context of investor-state arbitrations. In addition, her sense of humor, level-headedness, and practical guidance are qualities that make working with her a pleasure when the stakes are high. There are very few lawyers of her caliber in the field.

Dispute resolution > International litigation Tier 1

The international litigation group at Debevoise & Plimpton LLP is jointly led by Andrew Ceresney and Mary Beth Hogan, bringing together expertise in white collar and regulatory defense, and commercial litigation. For criminal investigations and disputes with a political flavor, Washington-based David O’Neil is the name to note. In New York, regulatory defense specialist Bruce Yannett is a key contact for fraud- and bribery-related claims and stands out for his experience acting for corporations and individuals outside the US. Indeed, the group’s visibility internationally is not to be questioned — in one recent highlight of many, the team successfully represented the Government of Qatar in a dispute concerning coercive measure brought before the International Court of Justice (ICJ). Donald Donovan and Catherine Amirfar jointly led the matter for Qatar and are highly regarded for their work on contentious issues involving a public international law (PIL) element; former president of the International Bar Association David W. Rivkin has also made a name for himself in the PIL space. The group’s strong suit in high-stakes commercial litigation is also noted, with particular expertise held in the areas of insurance, private equity and healthcare, among others.

Labor and employment > Employee benefits, executive compensation and retirement plans: transactional Tier 1

Debevoise & Plimpton LLP’s New York-based employee benefits and executive compensation team is particularly active in the investment funds space, including the rapidly growing secondary market. Experts such as practice head Lawrence Cagney and recently made-up partner Franklin Mitchell advise big-ticket fund managers or financial services clients on ERISA fiduciary responsibility for multibillion-dollar investments of pension plan assets. The team is also retained by a roster of private equity houses, for whom Meir Katz and Jonathan Lewis provide equity-based incentive and tax-related assistance on M&A transactions and spin-offs in sectors involving media, pharmaceuticals and healthcare. Though the practice has a focus on private equity and investment funds, a number of public companies are also noted; these include The Walt Disney Company, with Cagney advising on incentive revisions for its integration with 21st Century Fox. Elizabeth Pagel Serebransky recently retired from the partnership.

Dispute resolution > Securities litigation: defense Tier 2

'It has great quality of litigators in its securities litigation practice', says a client of Debevoise & Plimpton LLP in New York. The firm handles a broad palette of work incluing federal securities class action litigation, state court M&A and fiduciary duty disputes, multi-jurisdictional and multi-disciplinary matters, and cases in which civil litigation, federal and state enforcement actions and others  legislative inquiries overlap. A core strength of the firm is its outstanding capability in federal and state enforcement actions, in which former chair of the SEC Mary Jo White takes the lead. This practice works closely with the securities litigation group, which is led by Andrew Ceresney, a former Director of Enforcement at the SEC, and standout partner Maeve O’Connor. The firm's insurance regulatory practice gives it a lead role in high-profile securities disputes for clients such as MetLife and Prudential Financial. The firm also acts for large corporates in other industry sectors, as well as for their boards of directors and special board committees.

Testimonials

The firm has great quality of litigators in its securities litigation practice.

Maeve O’Connor and Elliot Greenfield are excellent.

I worked closely with Debevoise on high-stakes securities matters and was extremely pleased with their work. They are the smartest lawyers I have worked with. They think strategically, while at the same time keeping value in mind.

I worked closely with Maeve O’Connor and Elliot Greenfield. They are both incredibly smart and able to digest the most complicated and sophisticated issues faster than anyone else I have ever worked with. Maeve’s intellect and presence make her a formidable opponent to plaintiffs’ lawyers. Maeve is also able to identify risks that could affect public companies outside of her specific expertise. Her knowledge and experience in the insurance industry provides additional value.

Perhaps given his quantitative background, which is unique to attorneys, Elliot Greenfield is able to understand complex damages analyses at a depth that other attorneys are not. Equally important, is his ability to break down and communicate these complicated analyses into simpler terms, conveying only the necessary information and ideas.

The team, which is spread between the firm's New York and Boston offices, sees a regular deal flow from major clients such as Bain Capital and Silver Lake Partners. The recent recruitment of Willkie Farr & Gallagher LLP's finance chair Leonard Klingbaum as well as Andrea Hwang not only added to the firm's New York office (especially following the departure of Sunil Savkar to Debevoise & Plimpton LLP), it also strengthened the firm's offering in the alternate lender space, where Alyson Gal in Boston and Joanne De Silva have also made good headway. On the borrower side, Boston's Byung Choi and Kevin Jarboe are very well regarded, as are practice head Stefanie Birkmann and Alexander Zeltser in New York.

Not Just Talk: From Idea to Action

At Debevoise, we ensure that associates have a voice in how the firm follows through on its commitment to diversity and inclusion. We value their ideas and we don’t just listen—we act. For example, the firm recently developed a new diversity training program aimed at mid-level and senior associates who are involved in assigning work to, and supervising, junior lawyers and staff. This new program was suggested by an associate at an affinity group meeting. Within a month, we had developed a program and added it to the firm’s regular mid-level and senior associate training curriculum.
