Winn Solicitors > Firm Profile
Winn Solicitors is a leading law firm providing services to clients across the UK.
The firm: Winn Solicitors Limited was established in 2002 by Jeff Winn and Ghazala Bashey, with the primary purpose of handling personal injury claims. The highly specialised firm, which is based in Newcastle upon Tyne, has grown rapidly and is now a leading nationwide provider of personal injury legal services.
The company has a group structure, with Winn Holding Limited sitting above Winn Solicitors and its subsidiaries. Over 300 staff are employed across the group, with over 250 working in legal roles.
In 2013, Winns was approved as an alternative business structure (ABS). To date, it remains the largest law firm in the North East to hold ABS status.
An award-winning firm, Winn Solicitors prides itself on providing an exceptional service to all clients, making the claims process as efficient as possible.
Types of work undertaken: Winns specialises in personal injury in relation to road traffic accidents, employers’ liability and public liability claims. The firm has an excellent reputation for delivering an outstanding service and has developed a strong track record for handling complex accident claims.
Litigation: in January 2014, Winns set up its litigation team, to ensure high client care standards are upheld despite industry changes. The team deals with strategy in handling technical litigation challenges, including test case litigation. The team also provides extensive training to the rest of the firm to ensure matters are dealt with in a unified and systematic way.
In February 2016, the firm had a significant victory at the Court of Appeal with the Broadhurst v Tan, Smith v Taylor case, securing a landmark ruling where if a Part 36 offer is beaten at trial, indemnity costs are payable, rather than just fixed costs. The firm triumphed at the Court of Appeal again in March 2016, with the Phillips v Willis case, which saw Lord Justice Jackson overturn a judgment allowing delays and inefficiencies in the MOJ Portal. Both victories served to shape the industry and help to advocate for more streamlined, user-friendly procedures for claimant solicitors nationwide. As a result of the firm’s hard work in relation to these rulings, Winns was awarded Outstanding Achievement of the Year at the 2016 Personal Injury awards.
Ghazala Bashey and the litigation team successfully argued an important test case in October 2013. Winns was involved in litigation with over 20 major insurance companies and their solicitors in a wide-scale challenge to the recoverability of claimants’ after-the-event (ATE) insurance in cases where the claimant had pre-existing before-the-event (BTE) insurance via their motor insurance policy. This was a landmark case and the team successfully argued that it was reasonable for claimants to undertake an ATE policy if their existing BTE policy was unsuitable for their claim. The success resulted in the recovery of over £3m in ATE premiums for Winn’s clients, and also had a major impact on many other claimant personal injury firms who were involved in similar challenges.
Complex claims: Winns set up its multi-track team in November 2012 in response to the growing number of serious injury instructions the firm was receiving. The team was later renamed the ‘complex claims team’ to reflect the complexity and diversity of claims being handled. In 2016 Winns appointed specialist brain injury solicitor David Burn. David is also branch secretary at Headway County Durham, and has championed getting the firm listed in the Headway recommended head injury solicitor directory. The team is currently staffed by five grade A fee-earners, led by Jo Amos, and specialises in handling claims involving acquired brain injury, amputations, head and spinal injuries, multiple fractures, tinnitus, fatal accidents, chronic pain syndrome, as well as psychiatric injuries including post-traumatic stress disorder and depressive disorders.
Employers’ liability/public liability: since its inception in May 2014 the EL/PL team has been dedicated to pursuing non-RTA personal injury claims, including accidents at work, occupiers’ and public liability claims as well as holiday claims, and more complex and higher value multi-track EL/PL claims. Two qualified and experienced solicitors also work in this team, specialising in technical fast-track and lower value multi-track claims, together with three legal clerks who deal with Portal and disputed fast-track claims.
