Jana & Gil Dispute Resolution

Chile > Dispute resolution: arbitration Tier 1

Emerging from the dissolution of Bofill Mir & Álvarez Jana Abogados (BMAJ) during 2022, Jana & Gil Dispute Resolution houses one of Chile’s foremost arbitral practitioners, co-founding partner Andrés Jana (‘a recognised arbitrator and counsel worldwide‘), who has vast experience in domestic and international disputes involving commercial, investment and international public law issues, before the International Court of Justice (ICJ) and ICSID. Jana is joined by Rodrigo Gil, who has longstanding experience in contractual disputes under international commercial arbitration rules (ICC, UNCITRAL and CAM Santiago), as well as in ad-hoc and national arbitrations; and younger partners Karen Werner  (included in CAM Santiago’s list of Young Arbitrators); and Carla Dittus , who routinely acts in national and international arbitrations, and who made partner in January 2022 (while at BMAJ). Rounding out the current senior team is Francisco Grob, who joined the firm as a partner from his position as legal counsel at ICSID’s World Bank Group in July 2022. At senior associate level, Victoria Demarchi acts in both commercial and investor-state disputes; Alfonso Marcos‘ experience includes ICC, ICSID and CAM Santiago cases; Benjamín Silva is a former international associate at Baker Botts (UK) LLP‘s London office; and arbitration expert Juan Pablo Labbé joined pre-split BMAJ in December 2021 from Cariola Díez Pérez-Cotapos. Nicolás Zisis did not join the new firm, leaving for Fix Abogados in late 2021.

The domestic and international arbitration team’s work is extraordinary and very up to date, with a very in-depth analysis of matters that left us very satisfied. I understand that this year the lawyers will form their own boutique dispute resolution office and I think it will be very successful!

Andrés Jana stands out for his enormous experience in international arbitration. He is a recognised arbitrator and counsel worldwide.

Andrés Jana stands out for his high-level technical knowledge, handling of relevant issues, and quick understanding of cases perfectly.

Karen Werner is a member who handles arbitration very well – she also works as an arbitrator at CAM Santiago. Karen is creative and highly detailed, and has quickly established herself in the local market as one of the most well-known litigators around.

Senior associate Benjamín Silva impresses with his knowledge of international arbitration. You can tell he has experience in working on complex cases. I highly recommend him.

Chile > Dispute resolution: litigation Tier 2

One of the firms emerging from the early-2022 dissolution of Bofill Mir & Álvarez Jana Abogados (BMAJ), boutique outfit Jana & Gil Dispute Resolution has a ‘tremendous‘ disputes practice that is experienced in representing clients from a range of sectors in their litigious (and arbitral) proceedings in Chile, including mining, energy, retail, finance and infrastructure-related matters. The core group of practitioners – who have many years’ experience, working together – includes founding partner and domestic and international disputes expert Andrés Jana; fellow name partner Rodrigo Gil, a specialist in large-scale construction disputes; and Karen Werner, who is ‘recognised as one of the market’s most outstanding young lawyers‘. Also key to the department are Carla Dittus, who was made partner in January 2022 (while at BMAJ) and who regularly acts in conflicts before the ordinary courts of justice; and Tomás Bown, the civil and commercial litigation group’s key senior associate.

The group stands out for taking on complex cases, which other firms would hesitate to take on, dedicating all its efforts and professionalism to carrying out an excellent job.

A tremendous litigation team.

The team recently announced that it will form its own boutique dispute resolution office, led by Andrés Jana. I have no doubt that it will do very well – they are great lawyers.

The strong point is the great commitment to clients, and the creativity with which the lawyers approach all issues. I have been amazed at the depth of the analysis, and how quickly the team goes through all the details of each case.

An excellent dispute resolution group that is led by partners Andrés Jana and Karen Werner. Both are excellent trial attorneys and possess technical skills that set them apart from other firms in this area.

Karen Werner stands out for her intelligence, professionalism, dedication and care taken during every case in which she is in charge. The result obtained was excellent and working with her was a pleasure.

Karen Werner is recognised as one of the market’s most outstanding young lawyers.

Karen Werner is a tremendously diligent attorney who never misses a thing. No matter how many things she does in parallel, she always has everything under control. She delves deeply into cases, takes great care of clients and never strays from a matter. I have known her for many years and the evolution she has had in the market is truly remarkable.

Chile > Bankruptcy, insolvency and restructuring Tier 3

Boutique firm Jana & Gil Dispute Resolution spun out of Bofill Mir & Álvarez Jana Abogados (BMAJ) in May 2022, retaining former bankruptcy and insolvency practice co-head Karen Werner, along with experienced senior associate Tomás Bown. The pair have an established track record working together on insolvency mandates with recent matters including advising Bureau Veritas on the bankruptcy process of Sadeven Ingeniería; Alexim and Bureau Veritas on the bankruptcy process of Compañía Minera Dayton; and Bice Vida subsidiary Desarollos Inmobiliarios y Constructora Valle Grande (IVG) in the liquidation process of Nova Terra. More generally, Werner’s experience includes acting for clients from the mining, infrastructure and energy industries (both as debtors and creditors) in bankruptcy and insolvency-related judicial proceedings. Former co-leaders of BMAJ’s bankruptcy and insolvency practice, Octavio Bofill and Alejandro Álvarez, have now both set up their own firms.
