Bjørnar has been Deputy Director of the legal department in the EFTA Surveillance Authority and was also for an extended period Acting Director of the department. He has outstanding experience in litigation before the EFTA and the EU Courts, having represented the EFTA Surveillance Authority in over 20 cases in almost all fields of law covered by the EEA Agreement and the EU treaties. Several of the cases concerned questions within the field of state aid and public procurement. He has also worked extensively with questions pertaining to the free movement of goods, services, labour and capital, in addition to the rules on establishment, competition law, labour law and financial services. Further he has acted as Hearing Officer for competition cases in the EFTA Surveillance Authority. Alterskjær has been Manging Partner in Kluge since 2018.

Frederik Nordby
Frederik Nordby
Frederik Nordby works primarily with public procurement law, state aid law and other EU/EEA law. Within public procurement, Nordby assists both public entities and private operators in procurement processes. He has particular experience with procurement of complex ICT systems, and he therefore has good knowledge of ICT contracts as well. He also has broad experience from litigation procedures, both before the courts as well as before the Norwegian Complaints Board for Public Procurement. Nordby also has broad experience within state aid law, where he primarily advises public entities on state aid law, and assists in notification procedures before the EFTA Surveillance Authority (ESA). Nordby har previously worked in ESA's competition and state aid directorate, and as a research assistant at the Centre for European Law at the University of Oslo.

In addition to advising on and negotiating agreements and other transaction related documentation, he has a long experience with transaction tax advice, especially where a human capital element is prevalent. He especially deals with TMT and human capital intensive businesses such as transactions involving consulting firms. Works with CMS Kluge's IP, technology and EEA department, where he works in particular with Intellectual Property Rights and contract law. Provides assistance related to patent, trademark, design and copyright disputes and matters under the Marketing Act and the Act relating to Trade Secrets. The work within patent rights concerns in particular negotiations and dispute resolution in cases of patent infringement and validity of patents. Furthermore, he assists in trademark disputes and has represented several clients in cases before the Norwegian Industrial Property Office and the Board of Appeal for Industrial Property Rights. Høines also assists in cases concerning copyright infringement, product licensing and competition clauses, and regularly represents clients in the courts. Also assists clients with drafting and negotiations of contracts related to technology development, NDA’s and R&D projects, including cooperation and partner agreements related to development and commercialization of technology. He also has broad experience with various contracts related to development and licensing of technology and software. Høines frequently assists clients in connection with technology transactions.

Assists both Norwegian and international companies and organisers in connection with processes on the Oslo Stock Exchange. Thea has assisted several companies and investment banks in equity capital market transactions, including private placements and IPOs in various business sectors.

She provides expertise on drafting and negotiating contracts. Extensive experience on court proceedings after more than two years as a deputy judge in Norway’s second largest district court. Assists clients on issues regarding commercial real estate, including real estate transactions and lease contracts for existing or new building projects. Her work often consists of drafting contracts and assisting clients with negotiations. Tyvold is experienced with drafting cooperation agreements and shareholders’ agreements in real estate projects.
