The Law Comes Full Circle On The Issue Of Ex Post Facto Environmental Clearance

In Vanashakti v Union of India, 2026 INSC 761 a three-judge bench of the Supreme Court pursuant to review proceedings settled the long-contested issue of ex post facto Environmental Clearance (EC) granted under the Environment Impact Assessment Notification, 2006 (EIA Notification, 2006). The Court held that the prior EC regime is mandatory in nature and upheld the validity of the 2017 Notification issued by the Ministry of Environment, Forest and Climate Change (MoEFCC) as a time bound amnesty scheme, and struck down the 2021 Office Memorandum (2021 OM) as an impermissible administrative action with prospective effect. The Court passed a common judgment and order in a group of petitions.

Sectoral Regulatory Laws And The Competition Commission Of India: Revisiting The Interface After The Amendment Act Of 2023

India has two regulatory layers- sector regulators since the 1990s and the CCI, which alone handles competition matters since 2002, and this has created real gaps and clashes, as seen in telecom, electricity, aviation, and conflicting court rulings. The article argues this isn’t a genuine conflict but a design flaw as the CCI is best placed to judge competition consistently, while sectoral regulators bring technical expertise the CCI lacks. This gap was flagged back in 2011 in a policy draft that was never implemented. The article proposes practical fixes, mandatory coordination, sunset clauses for outdated rules, and a revived regulator forum.

Drafting For An Exit That May Fail

An exit clause may look complete because it specifies a date, a return and a payment formula. It may nevertheless be unworkable if, when performance falls due, the proposed exit cannot lawfully be implemented or a third-party approval halts such exit that the documents do not adequately address. The problem is not confined to any particular instrument, way of drafting or transaction structure. Unless the documents identify and allocate those constraints when the exit is negotiated, structured investments, deferred consideration, earn-outs, put and call arrangements, third-party dependent exits and consent-dependent distributions can turn a promised commercial outcome into a performance dispute.

An Update On India’s Proposed Digital Competition Law

India’s proposed Digital Competition Law has evolved through several stages, from the 2022 Parliamentary Committee report and the 2024 Committee on Digital Competition Law’s draft Bill, through a 2025 government reconsideration, to renewed Parliamentary backing for an ex-ante framework in August 2026. Drawing on comparative experience from the EU, UK, and Japan, this article argues that legislative reform must be matched by a strengthened Competition Commission of India if ex-ante regulation is to work in practice.
