Position

Daniel practises in all areas of intellectual property law and commercial disputes involving the same, including patents, trademarks, passing off, copyright, designs and confidential information. He has been (and is) instructed on some of the most high-profile litigation at the IP Bar, including: the Warner Lambert damages inquiry (follow on inquiry in relation to second medical use patent for pregabalin; selected by The Lawyer as one of the “Top 20 Cases of 2023”); Nokia v Oppo (patent for 4G LTE transmission); Swatch v Samsung (trade mark infringement of the Swatch Group’s famous Swiss watch brands; appeal to the Court of Appeal in December 2023); Lidl v Tesco (trade mark infringement in respect of Tesco’s clubcard); and M&S v Aldi (UK registered design infringement of M&S’s “light up gin bottles”; appeal to the Court of Appeal in January 2024).

Daniel is also one of the most frequently instructed barristers at the UK Intellectual Property Office, with over 15 appearances scheduled for 2023 alone.

Career

Called 2013, Lincoln’s Inn; previously a Fellow of Oxford University (Bionanotechnology); Contributing author to Terrell on the Law of Patents (19th edition, 2020), the leading practitioner textbook on UK patent law.
