Career
Kathryn McCulloch is a partner in Dentons’ Dispute Resolution group, whose key areas of practice and expertise include aviation, drone (RPAS) regulation, wills, trusts and estates, corporate/commercial issues, commercial leasing and oppression actions. With a strategic focus on reaching early resolution to claims, Kathryn looks to achieve timely resolution of disputes through alternative dispute resolution tools, including formal and informal mediation.
Kathryn has deep experience practicing in drone and aviation regulation. Kathryn advises clients from all corners of the drone industry, including: drone operators, consumer associations, navigation service providers, production companies, start-up and technology companies and non-aviation companies from an array of industries engaging in drone services. Kathryn is also a licenced fixed-wing aircraft pilot, a member of the Canadian Owners and Pilots Association, and holds an RPAS Certificate for Basic Operations. Her intimate knowledge of Canadian airspace structure and air traffic rules and procedures inform her drone regulatory practice to ensure she provides strategic regulatory and business advice for companies in this emerging area.
Kathryn’s more traditional aviation practice focuses on liability of commercial airlines, airports and air operators, and the regulatory framework in which they operate.
Kathryn’s wills, trusts and estate litigation practice includes highly contentious disputes over powers of attorney, will challenges, trust variation and rectification, breaches of trust of fiduciaries, and intestacies. Core to her wills, trusts and estate litigation practice is the defence of allegedly negligent solicitors. Mediation is a central aspect of Kathryn’s estates practice, which allows families to reach consensus and timely resolution, rather than engage in protracted litigation proceedings. Kathryn also assists clients in applying for probate, whether the deceased died with a will or without.

The team at Dentons is well-versed in aviation issues, namely complex and structured financing transactions and compliance mandates. International aviation financiers, commercial and business aircraft lessors, aircraft chartered companies, airports and private operators routinely feature on its broad client roster. Vancouver-based practice co-head Robert Quon specializes in assisting aviation and aerospace clients with corporate and commercial transactions. Alongside him, Kathryn McCulloch co-leads from Toronto and has niche expertise in the regulatory structure for drones; her robust traditional aviation practice includes representing commercial air operators in litigation. In Montreal, partner Marie-Josée Couture assists with financing transactions.
