Dispute Resolution and Litigation, Restructuring and Insolvency

Position

David is an advocate providing specialised advice in relation to business restructuring and insolvency in contentious, non-contentious and multi-jurisdictional matters.

In his time with Carey Olsen David has been involved in many of the largest insolvencies involving Guernsey entities, ranging from investment funds to global retailers. He is able to assist lenders in respect of the taking and enforcement of all forms of security. David regularly advises the boards of distressed entities and has extensive experience acting for office holders.

Notable matters include advising in relation to the restructuring and/or formal insolvencies of Joannou & Paraskevaides (Overseas) Limited, the philatelic investment business Stanley Gibbons (Guernsey) Limited, The Long Port Group and HMV Group plc. He has advised on the acquisition, restructuring and enforcement of a number of high value, multi-jurisdictional, non-performing loan portfolios on behalf of hedge fund acquirers.

David is a member of the Insolvency Lawyers Association and R3 and sits on the young members Committee of INSOL International. David lectures on INSOL’s Foundation Certificate in International Insolvency and is part of the working group tasked with updating and revising Guernsey’s insolvency laws. He has also been appointed as a member of Guernsey’s first ever Insolvency Rules Committee (IRC).

Career

David qualified as a Solicitor of the Senior Courts of England and Wales in 2004. He was called to the Guernsey Bar in 2014. He was made a partner at Carey Olsen in January 2019.

The firm also has a dedicated restructuring and insolvency team, led by David Jones. Elaine Gray heads up the wider disputes team, handing a broad range of contentious matters, including breaches of trust and professional negligence. Tim Corfield has built up a strong corporate disputes practice, while Mark Dunster handles regulatory and criminal matters.
