Position

Russell Clark heads up the trusts and private wealth team in Guernsey. He advises on both contentious and non-contentious trust and private wealth matters. He also advises private clients on succession, estate planning and family governance.

Russell was elected as a member of The International Academy of Estate and Trust Law (TIAETL) and is a member of the Association of Contentious Trust and Probate Specialists (ACTAPS).

He is also a member of the Society of Trust and Estate Practitioners (STEP), having previously been Chairman of the STEP Guernsey Branch Technical Committee and a Branch Committee member for 18 years.

Russell is the only Guernsey lawyer to be ranked in the ‘Hall of Fame’ in the Legal 500 UK and as a Band One practitioner for Guernsey in Chambers HNW Guide in their latest editions. Russell has also been recognised by Best Lawyers  as one of ‘The Best Lawyers in the United Kingdom’ in their 2024 edition for his work in trusts and personal tax law.

Russell has been named as one of the 2022 eprivateclient 50 Most Influential for 2022. He has also been recognised in Legal Week’s Private Client Global Elite listings 2018 to 2022 and featured in the Spear’s 500, 2022 and 2023 list of top private client lawyers.

Russell is also a Notary Public and advises on Guernsey, Alderney and Sark law.

Career

Russell was admitted as a Solicitor of the Supreme Court of England and Wales before returning to Guernsey where he qualified as an advocate in 1997. He was made partner in 2001. Russell became a Notary Public in 2006.

Carey Olsen‘s team supports HNWIs with the setup and restructuring of trusts, private trust companies and family offices, while working alongside the firm’s litigation practice to represent clients engaged in multijurisdictional trust disputes. Practice head Russell Clark handles both contentious and non-contentious trust matters, notably advising on the establishment of complex trust structures. Natasha Kapp‘s practice encompasses both private wealth structuring and philanthropy, as well as contentious trust issues. Having retired from the partnership in June 2022, Konrad Friedlaender continues to advise on a wide range of trust matters in addition to pensions, employee benefit and share option schemes as a consultant. Counsel Laila Arstall focuses on a wide range of tax issues, while fellow counsel Wendy Garrard assists trustees, beneficiaries and protectors with matters concerning regulatory and fiduciary law.
