Phil has extensive experience in the public and private sectors and advises clients on commercial contracts, data protection issues and IT/technology contracts.

He is a well respected lawyer who has worked with numerous high profile clients in the automotive, energy and manufacturing sectors.

Phil has extensive experience in commercial contracts and has advised on a number of outsourcing, facilities management and services arrangements.

He has dealt with various complex manufacturing agreements including those dealing with cross-jurisdictional issues.

Phil has advised on and negotiated distribution, agency and other commercial arrangements.

Having given advice on IT and technology contract for over 15 years, Phil has a wealth of experience in all aspects of IT and technology law including advising on IT outsourcing arrangements (including offshoring), cloud software solutions, escrow agreements and software licensing, support and maintenance issues.

He understands the need to draft agreements to suit client needs and to meet client requirements be it a complex multi-party revenue sharing arrangement or a short heads of terms document.

His experience in drafting consumer contracts has resulted in him getting a plain English crystal clear mark award for a client’s contracts. He has advised on various consumer-related issues including advice on prize draws.

Phil is an acknowledged expert on information law and has extensive experience on data protection and freedom of information.

He has advised clients on contentious data subject access requests, data compliance programmes, dealing with data security incidents, big data issues and looking at issues relating to the export of personal data outside the EEA.

Phil is the co-editor of the Information Sharing handbook (2011) published by the Law Society.

Ward Hadaway draws on expertise from its commercial, property, construction and corporate teams to advise on the full spectrum of energy sector matters. Regular instructions include issues pertaining to fossil fuel, renewable energy, low carbon supply chains, utilities, offshore production and energy technologies. Clients include developers, investors, major multinational organisations and national businesses, for which it handles project development matters - with particular focus on anaerobic digestion, biomass and energy-from-waste projects - alongside offshore supply chain and mining sector issues. Consultant Mark Whitehead leads the team, which includes Tim Care, who is experienced in assisting public sector clients with generation and efficiency projects as well as energy procurement; Phil Tompkins, who is the main contact for power transmission and distribution matters; and commercial team head Colin Hewitt, who focuses on biofuels and biomass projects as well as oil and gas sector supply chains and carbon trading matters. Ward Hadaway’s clients include IT providers and developers alongside public and private sector customers. Judy Baker assisted Newcastle International Airport with contract negotiations for the supply, support and maintenance of airport check-in systems and self-service check-in kiosks, and advised Bannatyne Fitness on a contract with Navarino Services with regards to the client’s hotel booking system. In other work, she advised a national retailer on website compliance issues, and assisted a software house with liability provisions pertaining to the public procurement for IT software and services. Team head Alex Shiel advised a major port operator on a contract for the implementation of a new automated gate entry system.
