Mark is a highly experienced commercial, IP and technology lawyer who provides advice on a variety of technology, infrastructure and commercial contract matters for clients ranging from growing businesses to banks, infrastructure providers, and major suppliers and buyers of IT services. Mark combines in-depth commercial expertise, specialist technology know-how and a highly practical approach to advising clients on a range of matters, including IT services agreements, software licensing, cloud outsourcing facilities management, data centres, internet and e-commerce issues. Mark works across a number of sectors but has particular expertise in advising within financial services and retail. Experience: acting for a UK investment bank on a major data centre programme, including advice on modular data centre projects and a mission-critical new-build co-location agreement; advising infrastructure as a service provider on service agreements and major renewals with international consulting firms and service providers; acting for a multinational company on major facilities management outsourcing agreements, including cleaning and catering supply agreements; advising an international investment bank on new trading platforms for high-frequency trading.

Charles Russell Speechlys LLP's market-leading reputation for sports law makes the area one of the bedrocks of its commercial contracts practice. The firm's offering in this space was bolstered by the arrival of the team from commercial sports law boutique Couchmans following a high-profile merger in January 2018; Nic Couchman, Nick White Jody MacDonald and Satish Khandke moved across. A group including practice head Jason Saiban, Megan Paul (who was hired in 2017 from Mayer Brown International LLP ) and associate Richard Davies acts as Nike's primary legal advisers in the UK; recent work included assisting the client with the rollout of its cutting-edge omnichannel offering and assisting with event staging arrangements for the World Championships in Athletics 2017. Elsewhere, the firm also has an outstanding reputation in the retail and TMT sectors, as is evidenced by the fact that its client roster includes names such as Westfield, Harrods and ITV. David Berry handles commercial contracts with a nexus to the IT, financial services and energy/natural resources sectors. He also heads up the firm's cleantech and renewables group, and has also developed an interest in the role of technology across a wide range of industries. Jaclyn Wilkins and Mark Bailey are other key figures. Ian Lynam and Jon Walters departed for Northridge Law.

With blockchain and payments having been its core pillars for some time, the team at Charles Russell Speechlys LLP is also highly active in regtech and ICOs. Financial services regulatory expert William Garner, who is strong in blockchain, ICOs, payments and broker-related work, heads the department jointly with technology infrastructure and outsourcing expert Mark Bailey. Garner continued to assist SETL Development with regulatory matters, and Bailey advised insurance platform Cheshire Datasystems on various GDPR issues and on its move to cloud-based solutions. On the corporate side, Duco Technology instructed William Nash on an $28m investment by Insight Venture Partners, NEX Opportunities and Eight Roads Ventures, and Tim Ball advised Nxtera on its £13m sale to an undisclosed buyer. One Ragtime Platform, Conferma, R5FX and, more recently, Kuende are all clients of the practice. Senior associate Richard Ellis joined in September 2017 from Gowling WLG; he is a financial services regulatory specialist with particular knowledge of crowdfunding.

The 'excellent' IT and telecoms team at Charles Russell Speechlys LLP sits within the firms wider TMT practice headed up by Mark Bailey and Mark Howard. The practice is frequently instructed in transactional and M&A matters in the technology sector. It advised IFS on its purchase of mplsystems, which provides contact centre and customer engagement software. The group also acts for  NCSOFT on day to day issues and commercially strategic matters, including negotiation of digital content agreements with industry leading distributors throughout Europe. Mark Moncreiffe is another key name to note, particularly for cross-border transactions. Megan Paul joined from Mayer Brown International LLP and is experienced handling commercial and outsourcing matters in the technology sector.

Commercial department head Jason Saiban¬†leads on marketing and advertising work and handles contentious and non-contentious instructions for media, retail and sports clients; and highlights include advising Wagamama on its media activities; and advising social and interactive media experts MBM on digital media agreements. Paul Stone¬†advises media sector clients on competition and regulatory issues and advises ITV, with senior counsel Mark Moncreiffe, on a range of corporate, commercial, dispute resolution and competition matters. Consultant media litigator Duncan Lamont¬†acted for various celebrity claimants in the group voicemail interception litigation against News Group Newspapers regarding the unlawful gathering of private and confidential information through voicemail interception. NCSOFT, Nike, Westfield, Paddy Power and YouView are also clients. Mark Howard¬†and Mark Bailey¬†head the TMT sector group, which includes senior associate Jaclyn Wilkins, who handles commercial and IP instructions and is particularly active in the computer games and interactive media sectors.
