Position

Joseph is a Partner of Shook Lin & Bok LLP who specialises in Litigation & Dispute Resolution, International Arbitration and Construction & Projects. He has experience in an extensive range of legal disputes including matters relating to financial services and securities, building and construction, infrastructure and projects, real estate sale and lease, employment laws and directors’ duties, commodities and trade, restructuring and insolvency, shareholders’ disputes and commercial fraud. He has appeared as lead counsel at all levels of the Supreme Court of Singapore, in international commercial arbitrations administered by leading arbitral institutions, and in construction adjudication proceedings commenced under the Building and Construction Industry Security of Payment Act (Cap. 30B). Joseph’s practice extends to the commercial preparation, negotiation and review of building and construction contracts, together with related non-contentious legal services. He is experienced and versed in the standard forms used also routinely employed in the industry such as the REDAS Design and Build Contract, the SIA Articles and Conditions of Building Contract, as well as the Public Section Standard Conditions of Contract.

Shook Lin & Bok LLP remains noted for insolvency, banking, commercial and fraud cases. The team represents a number of Indian and Chinese clients in arbitral proceedings. It acted for the receivers, FTI, in a case against the promoters of a resort in Thailand, with proceedings taking place in Singapore and involving an anti-suit injunction to prevent the promoters from pursuing their claim in Thailand. Sarjit Singh Gill SC, Probin Dass, Joseph Tay and David Chan are key members of the team.

Shook Lin & Bok LLP's team, which is led by Joseph Tay, has expertise in areas ranging from the drafting and review of contracts and project financing to regulatory and environmental issues. Clients include banks and government-linked companies as well as  construction and engineering companies, property developers and contractors. In recent work, it advised on a project to develop and build a facility on industrial land, which involved corporate real estate and landlord and tenant issues, as well as construction law. Debby Lim acted for a construction company in an adjudication concerning a payment dispute relating to the construction of a foreign workers’ dormitory.
