Corporate and M&A has long been a focus area at LawPlus Ltd. and the firm has continued to invest heavily in the corporate department with a number of hires and promotions in 2017 and 2018. Indeed, the firm hired corporate partner Kanjana Suthiprapa and senior associate Kachon Vannakun from Chandler MHM Limited, and also promoted Naddaporn Suwanvajukkasikij and Usa Ua-areetham to partner. The team has been busy with a number of acquisitions and joint ventures, and has also advised on various shareholder agreements, corporate contracts and business formations. In one recent mandate, Suwanvajukkasikij and Ua-areetham advised a multinational company on the registration and licensing issues arising from the establishment of its operations in Thailand. Managing partner Kowit Somwaiya is another name to note.

Dispute resolution

LawPlus Ltd. is regularly instructed in complex cases with over THB100m at stake and is also equipped to handle cases that exceed the THB1bn mark. Among its areas of expertise are shareholder disputes, labour litigation, product liability claims and insolvency proceedings. The combined strength of its dispute resolution and IP practices also ensures a regular stream of trade mark infringement cases; recently, it has handled trade mark lawsuits in Thailand, China, the United Arab Emirates, South Africa and Cameroon. Its lawyers have also acted as expert witnesses on Thai law in connection with international arbitration proceedings. The team secured a number of victories in 2017 and 2018. In one highlight, it achieved a favourable verdict for its client – the Thai subsidiary of a global healthcare company – in a long-running unfair termination case brought by two former employees at the Central Labour Court; managing partner Kowit Somwaiya and associate Wichayaporn Thangjittiporn, who played lead roles in the matter, also represented the client in a subsequent appeal at the Supreme Court.

IP is a key practice area at LawPlus Ltd.; the team continues to receive instructions from its longstanding clients and has also picked up a number of new clients from the health, education and technology sectors. Its trade mark practice remains buoyant, with recent work including Kowit Somwaiya’s representation of a client in trade mark oppositions against a trade mark squatter. Like other firms in the market, the team saw an uptick in patent cases in 2017 and 2018. Coypright work also features. Drawing on 17 years' experience, Prasantaya Bantadtan advises corporate clients on their IP issues in Thailand and internationally. At the associate level, Paramee Kerativitayanan is dedicated to IP prosecution and enforcement and has won several recent cases for clients.
