Failla&Partners is founded on the 35+ years of experience of founding and managing partner Luca Failla and the historical team he has worked with for those years.

For decades, they have been providing counsel on a wide range of people management issues that companies must face each day – in and out of court – from acquisitions to agency agreements, contracts to consultancy, disciplinary procedures and dismissals, executive benefits to European works councils, immigration to industrial relations, legal opinions to litigation, management models to mergers, social security to strategy, reorganizations to restructurings and so much more!

Today we find the close relationship between employers and their legal counsel has never been so important as together they survey a new landscape of work and productivity – to ensure business continuity and safeguarding employment where possible. It is in this spirit that Failla&Partners has established itself as a new Italian employment and labor law boutique with a solid foundation of work – for work – behind it.

The Failla&Partners team has an established history working at the international level on numerous cross-border matters together with leading employment law lawyers and law firms in foreign jurisdictions.

The network of personal relationships with the top international players in the market means that Failla&Partners can work closely together with trusted advisors as clients navigate the regulatory framework for workplaces beyond national borders.

Below are just a few of the numerous complex matters the team has advised on over the years – at times creating new legal precedents in the process:

  • MERGERS & ACQUISITIONS
Advised on the employment law aspects of the sale of an important retail activity with 700 stores and 2000 employees in Italy. The team also provided day-to-day counsel to this client post sale.
  • REORGANISATIONS
Advised an internationally recognized fashion label on a complex business reorganization of its Italian operations, which led to a 25% reduction of the workforce – hence saving 75% of the existing positions. Negotiations with the Italian Trade Unions and the Italian Ministry for Economic Development were required for a successful agreement – which also included the adoption of alternative measures aimed at mitigating the social effect of the redundancies.
  • DEMATERIALIZATION | SMART WORKING
Advised a company on the dematerialization of their back office and adopting Smart Working as a normal type of employment contract. The reorganization, which impacted 350+ employees, was implemented through the introduction of an innovative company collective labour agreement which identified a new relationship between salary and objectives for all the employees.
  • WORKPLACE INVESTIGATIONS
Advised an internationally recognized retail chain on a very sensitive internal investigation which uncovered sophisticated illicit activities carried out in one of its locations in Italy, involving 30+ employees during working hours. Disciplinary procedures were applied to all those involved – with a number of  dismissals involved.
  • CROSS BORDER
Management and assistance of the labor law profiles of a business transfer transaction involving the personnel of an Italian Company employed in more than 8 European countries.
