Antitrust being at the historical heart of their expertise, a law that they have contributed to shape as it has evolved.

Their careers have been punctuated by major cases (searches contestations, anti-competitive practices litigation before the French Competition Authority, the Paris Court of Appeal and the French Supreme Court, or before the European Commission and the EU courts), and by the successes they have achieved.

Tactics, including on specific issues such as public procurement or digital technology, has capitalized on its experience on the entire continuum of investigation / instruction / decision / appeal / indemnity / criminal litigation, from the searches to the issues of imputability, determination of sanctions, settlements, appeal techniques, and finally to private enforcement. In fact, at Tactics, antitrust proceedings, ā€œfollow onā€ commercial litigation and private enforcement are handled by the same lawyers.

To do so, it has developed a specialized legal expertise. The seriousness and complexity of these issues lead the team to work with multiple experts, within the framework of the Tactics network, depending on the issues encountered.

Merger control

TheĀ track record in complex mergers, both at the level of the French Competition Authority and the European Commission, bears witness to their ability to optimize the authorization in phase 1, or in the event of a phase 2, to preserve the economic interest of the transaction by negotiating proportionate and innovative remedies. Internationally, the lawfirm’s partners (Loraine Donnedieu de Vabres-TraniĆ©, Thomas Picot and Florent Vever) coordinate multi-jurisdictional filings, ensuring overall consistency, and act directly in certain areas where we have acquired particular experience, such as Morocco.

Commercial litigation

The team assists clientsĀ from the evidence collection phase and in futurumĀ investigation measures (whether they are implemented or resisted), litigation on the merits for complex and high-stakes private enforcement or unfair competition cases. It has developed a recognized expertise in damage assessment, with the assistance of highly regarded experts.

The team is also involved in cases of restrictive practices, whether it be cases of sudden termination of commercial relations, significant imbalance or non-compliance with payment deadlines, including during the pre-litigation phase or during DREETS investigations.

Consumer and food law

The team, led by Julia Bombardier, assists clients at all key stages in the life of a product: from its design and marketing to its advertising, and including DGCCRF/DDPP inspections. Their knowledge of the regulations (consumer information or product conformity and safety, with special expertise, particularly in the food sector) also enables them to assist the client in the context of criminal, commercial and administrative litigation.

The team intervenes in particular in cases of misleading commercial practices, deception on goods or aggravated deception. In this respect, it also advises companies on withdrawals and recalls of products and is involved in the management of health and food crises.

Compliance and internal investigations

The team has a long history with internal investigations, particularly in crisis situations, using internal and/or external “forensic” tools.

Similarly, it is highly experienced in the design compliances programs, adapted to the company’s culture (ethical charters, compliance codes, training programs or alert and monitoring systems), tailored to each company. This long-standing experience has enabled it to become operational as soon as the Sapin law and the AFA controls came into force (in particular, analysis of conflicts of interest and gift policies, evaluation of third parties, etc.).

Corruption

The team has developed particular expertise of the public procurement activity, both in competition and in criminal law.

It is thus able to develop defense defense and remediation strategies for the benefit of legal persons, in France, but also emerging countries, likely to be confronted with problems of corruption or favoritism.
