On June 6, 2023, Florida's Governor, Ron DeSantis, signed SB 262, which contains the Florida Digital Bill of Rights ("FDBR"), making Florida the tenth state to enact a comprehensive privacy law and the fifth state to do so in the past few months. The number of comprehensive privacy laws enacted in the U.S. has now doubled since the start of 2023. For the most part, these laws have followed a consistent framework and applied similarly to companies. However, the scope of the FDBR is distinctly narrower than the other state laws because most of its provisions will only apply to large technology companies. As a result, companies should carefully analyze the applicability of the FDBR to their respective operations. The FDBR will take effect on July 1, 2024 giving subject companies a little over a year to comply.
