California Supreme Court Revisits Insurer Duty to Indemnify for Cost of Environmental Clean-Up
County of San Diego v. Ace Property & Casualty Ins. Co.
California Supreme Court
California’s high court added two more opinions to the state’s line of coverage cases arising from environmental liabilities. In the companion opinions County of San Diego v. Ace Property & Casualty Ins. Co., 2005 WL 2060910, -- Cal.4th---- (Cal. Aug. 29, 2005) and Powerine Oil Company v. Superior Court ("Powerine II"), 2005 WL 2062032, -- Cal.4th---- (Cal. Aug. 29, 2005), the court acknowledged that indemnification for liabilities arising from environmental agency orders is determined by the specific language contained in the insuring clause.
