1. Summary

A new UK consumer protection regime came into force on 6 April 2025 through the implementation of the Digital Markets, Competition and Consumers Act 2024 (Commencement No. 2) Regulations 2025 (SI 2025/272) ("the Regulations"). The Regulations bring into force Parts 3 and 4 of the Digital Markets, Competition and Consumers ("DMCC") Act 2024, which update and replace the Consumer Protection from Unfair Trading Regulations 2008 ("CPRs"), as well as giving the Competition and Markets Authority ("CMA") new direct enforcement powers—including the ability to issue fines for companies that fail to comply with consumer protection laws—thereby removing the need for the CMA to rely on the courts to enforce the outcomes of its investigations.
