Teminatsız (Kapsam Dışı) Kalmaması İçin İşveren Mali Mesuliyet Sigortası Poliçesi Özel Şartlarına Eklenmesi Gereken Haller

İş kazası ya da meslek hastalığı sonucu ortaya çıkan maddi zararlar 5510 Sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunu hükümleri çerçevesinde tazmin edilmektedir. Fakat uygulamaya bakıldığında sosyal sigorta teminat limitlerinin, meydana gelen kazalar sonucundaki zararları tam olarak karşılamadığı görülmektedir. Bu durumda zarara uğrayan işçinin, Sosyal Güvenlik Kurumu'ndan aldığı tazminatı aşan zararlarının tazmini noktasında işverenlerin sorumluluğu devam edecektir. Ayrıca Kurum da şartları gerçekleştiğinde, işçiye ödediği tazminat sebebiyle işverene rücu edebilmektedir.
