Breaking Cartels: Will India’s Leniency Plus Regime Transform Competition Enforcemen

Cartels remain the most serious form of anti-competitive conduct under competition law. By coordinating prices, restricting output, rigging bids, allocating customers, or dividing territories, cartel participants replace competitive market forces with collusion, causing significant harm to consumers, businesses, and the economy. Such arrangements typically operate in secrecy, making detection one of the most challenging aspects of competition law enforcement worldwide.

Aircraft Repossession vs Going-Concern Value: How India’s New Insolvency Framework Changes The Position Of Aircraft Lessors

Airline insolvency presents a particularly difficult problem for insolvency law because the assets most critical to keeping the airline operational may not belong to the airline at all. Aircraft are frequently held under operating leases. When an airline enters insolvency, therefore, the resolution professional (“RP”) may be required to preserve the corporate debtor as a going concern while the aircraft lessor seeks to enforce its contractual and international-law rights to recover possession of its aircraft.

On 28.09.2026, while hearing the suit filed on behalf of Ms. Aaradhya Bachchan [CS(COMM) 230/2023] along with two connected suits, the Hon'ble Mr. Justice Anup Jairam Bhambhani of the Delhi High Court put to the Bar a question which goes to the root of the personality rights docket. As reported by LiveLaw, the learned Judge asked whether a person who may freely photograph the Taj Mahal may not photograph a celebrity, observed that "The conventional law says that copyright in that photograph belongs to the photographer", and asked whether the photographer's use of his own photograph then becomes a violation of the celebrity's personality rights.
