PolandEmployment and HR

The draft law published on 16 December 2025, implementing Directive (EU) 2023/970, sets out extensive new obligations for employers in Poland, aiming to strengthen equal pay for equal work or work of equal value between men and women. All employers will need to conduct job evaluations using objective, gender-neutral criteria, establish employee categories, create transparent pay structures, and provide employees with detailed information on remuneration. Organisations engaging at least 100 employees are to be obliged to report on gender pay gap and take remedial action where pay gap of at least 5% is revealed, while all employers face new information and consultation duties towards trade union organisations or employee representatives. The draft law introduces a reversed burden of proof and significant fines for non-compliance, hence employers should immediately review pay practices, update internal documents, and train staff to prepare in advance for June 2026
