This edition of Flash apprises you with Ministry of Corporate Affair's ("MCA") recent notification dated January 22, 2019 which is a step towards ensuring that companies who take goods or avail services from micro and small enterprises ("MSEs"), honour their payments in a timely manner. On a different front, MCA introduced Companies (Amendment) Ordinance, 2018 ("Ordinance") which came into effect on January 12, 2019. Section 10A of the Ordinance has re-introduced the requirement for every company incorporated after November 8, 2018 to procure a Certificate of Commencement of Business. This requirement was there under Companies Act, 2013 under the Section 11 too, however, it was omitted by Companies (Amendment) Act, 2015 with effect from May 29, 2015.
