New EU Public Procurement Regime: Legislative Process Begins

The European Commission has proposed a comprehensive overhaul of EU public procurement law through a single, directly applicable Regulation that would replace existing Directives. This fundamental reform introduces mandatory quality-weighted award criteria, liberalised negotiation procedures, and entirely new frameworks for security considerations and European preference in public contracting.

The European Commission published its proposal for a Regulation on public contracts and concessions to reform the EU’s public procurement regime. It invites views until 11 November 2026.

The proposed Regulation would introduce significant changes to the way goods, works and services are purchased through public procurement across the EU. Aims include simplification, greater flexibility and coherence of rules, more strategic procurement, improved economic security and strategic autonomy, and improved data and digital tools. The proposal includes a more liberalised approach to negotiation, mandatory quality-weighted award criteria, and entirely new policy chapters on security/resilience and European preference.
