When an executor or administrator fails to progress an estate, beneficiaries face uncertainty about their inheritance and limited information about what is causing the delay. This article examines the legal remedies available to heirs in Cyprus, from requesting accounts and court directions to seeking removal and replacement of an inactive personal representative.

What Beneficiaries Can Do About an Inactive Executor or Administrator

Beneficiaries may wait a considerable time for an inheritance without receiving a satisfactory explanation for the delay. A statement that the administration is “ongoing” says little about the work completed or what prevents distribution.

A beneficiary in this position can instruct a lawyer independently to examine the administration and pursue the matter on their behalf. Formal correspondence may resolve the difficulty; in other cases, an application to the court will be necessary. Removal of the executor or administrator is one possible remedy, although an order addressing a particular failure in the administration may be more appropriate.
