Chile's new Law No. 21,838 establishes comprehensive rules for technology and knowledge transfer between academic institutions and commercial entities, creating pathways for universities to license technologies and form science-based companies. The legislation addresses intellectual property rights, benefit distribution, and transparency requirements while promoting open access to publicly-funded research through a national repository managed by ANID.

1. Technology and knowledge transfer

The Law facilitates the use of research results beyond academia by promoting collaboration among higher education institutions, research centers and companies, the licensing of technologies, and the creation of companies to commercially develop such results. Where public funding is involved, the Law promotes equitable access to and the ethical use of these technologies.

2. Science- and technology-based companies

Higher education institutions may create or participate in science- and technology-based companies (“STBCs”), i.e., companies whose primary purpose is the commercial exploitation of technologies, patents, intellectual and industrial property rights, or other research and development results generated by universities, science and technology centers or companies, or through collaboration among them.
