Une décision rendue le 10 mai 2017 dans l'affaire Habitations Prestige design et Fils inc. c. Bélanger vient mettre en lumière l'importance de définir de manière précise les droits et obligations des parties dans le cadre d'un contrat de construction.

Les faits

Le 10 octobre 2013, un couple (les « Propriétaires ») retient les services de l'entreprise Habitations Prestige Design et fils Inc. (« l'Entrepreneur ») afin de réaliser divers travaux sur leur maison, dont notamment le rehaussement du toit, le remplacement de fenêtres et des travaux de maçonnerie. Les parties s'entendent alors sur un prix de 53 356,47 $.

Puisque les Propriétaires doivent quitter le pays pendant la durée des travaux, ceux-ci signent alors une procuration en faveur de l'Entrepreneur lui donnant « plein droit de décision sur les rénovations de la maison » et l'autorisant à faire « toute démarche auprès de la Ville ».
