The Hague Judgments Convention aims to simplify the global
recognition and enforcement of civil or commercial judgments. While
it represents an important step towards international judicial
cooperation, this article examines its scope, practical
implications, and potential limitations.
Introduction
The 2019 Convention on the Recognition and Enforcement of
Foreign Judgments in Civil or Commercial Matters ("the
Convention") was approved by the Hague Conference on Private
International Law ("HCCH") on July 2, 2019, following
eight years of negotiations. It seeks to streamline the process of
recognizing and enforcing court judgments across international
borders, promising to enhance legal certainty, reduce costs, and
save time for businesses and individuals involved in international
disputes.
